Dominate Fishing Terms and Conditions

These terms and conditions govern the provision of services by Dominate Fishing (“Dominate Fishing,” “we,” or “us”).

This agreement governs the sale of any Online Course and/or Subscription. Before purchasing an Online Course and/or Subscription, please read these terms and conditions carefully and print a copy for your records.

By clicking on the “Buy” button on our website, you agree to the terms of this agreement, which will bind you. If you do not agree to the terms and conditions set out below, you must immediately discontinue purchasing any Services from us.

  1. Definitions

“Confidential Information” refers to information provided by one party to the other in written, graphic, recorded, machine-readable, or other form regarding the other party’s business, clients, suppliers, finances, and other areas of its business or products, including, but not limited to, the Course Materials, but does not include information in the public domain other than through the party disclosing the information’s default, information required to be disclosed by a court, or information required to be disclosed by a government agency.

“Course Materials” refers to the content supplied by Dominate Fishing in hard copy or electronic format to complement a course offered as part of the Services.

The term “Fees” refers to the amounts you pay to Dominate Fishing for the Services.

“Intellectual Property Rights” refers to copyright, rights in or pertaining to databases, patent rights, performance rights, designs and registered designs, trademarks, and other intellectual property rights (registered or unregistered) worldwide.

“Online Course” refers to our provision of an online course via which you may study course materials remotely.

The term “Services” refers to the supply of the Online Course and/or the Subscription and/or the Course Materials, as well as any additional services agreed upon and paid by you through the Website from time to time.

“Subscription” refers to an in-person course taught by us in a classroom environment.

The term “website” refers to the URL https://www.dominatefishing.com/.

The term “you” refers to the individual who purchases the Services.

2. The Services

Our Website includes a description of the Services. We shall perform the Services with reasonable care and skill in line with the Website’s description.

We retain the right, without notice, to modify or discontinue any of the Services mentioned on the Website.

We anticipate that you will verify that the Services you are purchasing will fulfill your requirements. We offer no guarantees to you regarding the outcome of your purchase and completion of any of the Services.

3. Ordering Services

To make an online purchase of any of the Services, you must first create an account with us on the Website. If you already have an account with us, simply enter your user name and password to access your account.

By placing an order for a Service, you are making an offer to purchase it on these terms and conditions. At any moment, Dominate Fishing maintains the right to cancel or refuse your order, in whole or in part.

We shall contact you to confirm receipt of your order for Services placed over the Website.

A legally enforceable agreement between us and you will exist once we have accepted your offer to acquire Services from us by sending you an email confirming the purchase; and we have received payment from you of the applicable Fees.

Where your order includes several Online Courses or Subscriptions, we will regard each individual course as a distinct offer to buy. Acceptance of your offer to purchase one or more courses does not imply acceptance of your offer to purchase the remaining courses in your order.

4. Cancellation and Variation

If we accept / confirm the Services you have purchased and enter into a legally binding agreement with you, you may cancel your purchase of the Services within  7 working days of the day we enter into our agreement.

If you have purchased an Online Course and have already accessed, downloaded all or part of it, and/or begun using it, you will have no right to cancel your order.

There are no additional cancellation or modification rights associated with your purchase of Services, and any further cancellation and/or modification of course dates will be entirely at the discretion of Dominate Fishing.

5. Fees

Fees for Services will be as specified on the Website.

Unless otherwise indicated at the time you acquire the Services, the Fees are exclusive of VAT or other applicable local taxes, the cost of some Course Materials, and any shipping charges associated with the delivery of Course Materials to you. Each of these fees will be described in detail on the Website.

The fees associated with the Service you pick on the Website will be deducted from your credit / debit card at the moment of purchase. Payment in full is required prior to attending any Subscription or gaining access to any Online Course.

Any fees incurred by your debit or credit card provider in conjunction with your purchase of Services are your responsibility and will not be reimbursed by Dominate Fishing.

You are solely liable for any and all charges associated with your attendance at any Subscriptions or access to any Online Courses.

6. Liability

No portion of the Services shall be understood to be, nor is it meant to be, nor should it be construed as, investment advice.

While Dominate Fishing strives to provide the Services to the highest standards, neither it nor its trainers accept responsibility for any inaccuracies or misleading information contained in the programs or Course Materials, or for Client’s reliance on such information, or for any indirect, special, or consequential loss resulting from any breach of the terms of this Agreement.

Except as specifically stated in these terms and conditions, no additional conditions, guarantees, or agreements apply to the Services. 

Dominate Fishing’s total liability arising out of or in connection with these terms and conditions and anything we may do or fail to do in connection with these terms and conditions and the delivery of the Service (and regardless of whether the liability arises from a breach of contract, negligence, or any other reason) shall be limited to the Fees received by us in connection with the relevant Online Course or Subscription.

This Agreement does not restrict or exclude Dominate Fishing’s responsibility for (i) death or personal injury caused by negligence, (ii) fraudulent misrepresentation, or (iii) any other issue that cannot be limited or excluded under applicable law.

No claim may be lodged more than six months from the last date on which we delivered the Services in question.

7. Intellectual Property

All Intellectual Property Rights in the Course Materials, Online Courses, and trainer talks delivered during the Subscriptions are and will remain the property of Dominate Fishing or its licensors, regardless of whether they are adapted, developed for, or customized for the Client.

You are not permitted to:

  1. Without prior written permission, you may not duplicate, edit, reproduce, republish, sublicense, sell, upload, broadcast, post, transmit, or distribute any of the Course Materials.
  2. capturing the Online Course or Subscription on video or audio recording, relaying it by videophone or other methods.
  3. utilize the Course Materials in conjunction with the delivery of any other course or training, whether conducted by us or a third-party trainer.
  4. Remove any copies of Dominate Fishing’s copyright or other notices from the Course Materials.
  5. change, adapt, combine, translate, disassemble, decompile, or reverse engineer any software that is included in the Online Courses (except to the extent authorized by law).
  6. If you violate this paragraph, we may immediately terminate our relationship with you and discontinue providing you with any Services, including but not limited to access to the Online Courses.
  7. We offer you a limited, non-transferable, non-exclusive license to use the Course Materials and software associated with the Online Course solely for the purpose of completing the Online Course and/or attending the Subscription.
  8. Confidentiality

Each party agrees to maintain the other party’s Confidential Information in strict confidence, to use it solely for the purposes of these terms and conditions, and to return it upon demand without retaining copies.

Neither party is prohibited from disclosing Confidential Information to its legal or other advisers for the purpose of seeking advice.

This provision shall remain in effect even if these terms and conditions are terminated.

9. Termination

We reserve the right to immediately terminate these terms and conditions and discontinue providing you with any Services if you:

  1. neglect to pay your Fees when they are due.
  2. behave aggressively, bully, offend, threaten, or harass any employee of Dominate Fishing, any instructor or speaker who offers the Subscriptions, or any customer who attends a Subscription.
  3. are in violation of the foregoing terms and conditions.

Upon termination, the provisions of clauses 6 (liability), 7 (intellectual property rights), 8 (confidentiality), and 10 (assignment) shall survive.

10. Assignment

Any Services supplied by us to you according to these terms and conditions are personal to you and cannot be transferred or assigned.

We reserve the right to delegate these terms and conditions to any other firm without notifying you in advance

11. Complete Agreement

These terms and conditions constitute the whole agreement between the parties and supersede all prior written or oral agreements and arrangements. You certify that you entered into these and any other terms and conditions with us without relying on any representations. This section and the terms and conditions in no way diminish responsibility for fraudulent misrepresentation.

12. Force Majeure

Dominate Fishing shall not be liable to you for any breach of its obligations or termination under these terms and conditions caused by events beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes, and other Acts of God, terrorism, strikes, delays caused by transport disputes, failure to provide a course due to a trainer’s family member’s death, trainer’s illness, or a Government edict or regulation.

13.Transfer

We reserve the right to assign, transfer, or subcontract any of our rights or duties to any third party.

14. Jurisdiction and Law

This Agreement is governed by English law, and the parties irrevocably submit to the exclusive jurisdiction of English courts in the event of a dispute arising out of it.
